Regulatory Compliance & Human Oversight for Workforce AI and Agent Assist

Regulatory Status

  • EU: High-Risk AI System (Annex III)

  • USA: High-Risk / Consequential Decision Tool (Colorado SB24-205, NYC LL144)

  • Canada: High-Impact System (AIDA)

Intended Purpose & "Red Lines"

These systems are designed to evaluate professional communication competencies and adherence to business protocols.

Permitted Use: Analysis of linguistic clarity, script adherence, technical accuracy, and professional vocabulary.

Prohibited Use (Global): You must not use these systems to infer or analyze the emotional state, psychological health, or personality traits of employees.

Prohibited Use (EU-Specific): Using these systems for "Emotion Recognition" in a workplace context is a violation of Article 5 of the EU AI Act and may carry severe financial penalties.

Mandatory Human Oversight (The "Human-in-the-Loop")

To comply with global labor and AI laws, these systems are Decision-Support Tools, not automated decision-makers.

Verification: A qualified human supervisor must review and validate AI-generated scores before they are factored into an employee’s official performance record.

Override Rights: Supervisors must be trained to recognize potential AI errors (such as cultural linguistic nuances) and must have the authority to override AI scores.

No Automated Firing/Promotion: Decisions regarding hiring, termination, or promotion must never be based solely on AI outputs.

Transparency & Employee Disclosure

Transparency is a legal requirement in the EU, Canada, and several US states (For example, NY, CO, CA).

Prior Notice: You must notify employees before they are subject to AI-based monitoring.

Disclosure of Metrics: You must provide employees with a plain-language explanation of what the AI is measuring (for example, "The system checks for the use of mandatory compliance disclosures in your calls").

Right to Explanation: In the event of an adverse performance review, employees in many jurisdictions (EU/Colorado) have a legal right to a "plain-language explanation" of how the AI contributed to that decision.

Bias Monitoring & Data Governance

Algorithmic Discrimination: Deployers are responsible for ensuring the tool does not result in "disparate impact" based on race, gender, age, or disability.

Reporting: If you detect scoring anomalies that correlate with protected characteristics (For example, lower scores for specific accents), you must stop using the system for that cohort and notify Omilia immediately.

Audit Support: For clients in NYC or Colorado, we provide the "Technical Documentation" necessary to support your mandatory annual Bias Audits and Impact Assessments.

Maintenance & Record Keeping

Log Retention: Under the EU AI Act, you are required to keep the logs generated by this high-risk system for at least six months.

System Integrity: Do not attempt to modify the underlying logic or integrate the API with unauthorized "sentiment analysis" third-party tools, as this will void our compliance certification.

By activating these systems, the Deployer (Client) acknowledges they have read these instructions and agree to maintain human oversight as the primary authority for all personnel decisions.
